Information from the abstract
The article presents the results of the author’s empirical research conducted by interviewing 57 judges. The article analyzes the practice of using the institution of mediation in civil and arbitration proceedings, identifies the main barriers to its development, and assesses the attitude of the judicial corps towards mandatory pre-trial settlement and the potential of conciliation procedures in the Russian legal system. Based on the obtained data, the article formulates proposals for improving legislation and law enforcement practices.
